PHOENIX KENNELS, LLC PUPPY PURCHASE AGREEMENT

  1. Unless otherwise stated, all monies and prices are in US dollars.
  2. A minimum deposit of $400.00 is required in order to reserve a selection for a puppy.
  3. All deposits are NON REFUNDABLE. If the buyer decides not to take the puppy selection the buyer has reserved, the buyer may transfer the deposit to a future litter of the buyer’s choice. The buyer agrees that the transfer will result in taking a selection reservation after any already received deposits for the future litter. This transfer option is only possible prior to final puppy selection (below in Item 5), and the buyer must request in writing (email or letter) to Phoenix Kennels, LLC that the deposit be transferred to a future litter. This written request must be received prior to the final puppy selection deadline (below in Item 5).
  4. If an unforeseen event happens to said puppy or mother-to-be (death, false pregnancy, etc.), the buyer may choose from the next litter of the buyer’s choice. The buyer agrees to take a selection reservation after any already received deposits for the buyer’s next chosen litter.
  5. The buyer’s choice of puppy is determined on a first come (first deposit received), first to choose basis. The buyer will be supplied, by email only, with photos of available puppies some time after the puppies are over 1 week old. The buyer will be notified when a final puppy selection is to be made, after which the buyer will have 48 hours to make the final selection. Phoenix Kennels, LLC must be notified by email of the buyer’s choice. If Phoenix Kennels, LLC has not been notified in said time, the buyer forfeits ther choice until all others with deposits have chosen. After deciding on which puppy to take, the remaining balance is due. Phoenix Kennels, LLC must receive the remaining balance within 10 days after the buyer has notified Phoenix Kennels, LLC of the selection. If the remaining balance has not been received within said time, the buyer loses rights to the chosen puppy. Once a balance has been received, the buyer will be allowed to choose among any available puppies.
  6. If the buyer elects not to accept a puppy which has been chosen and fully paid for, only the remaining balance after deposit will be eligible for refund. If the buyer elects not to keep a puppy after having accepted the puppy (either by delivery or by personally taking the puppy), Phoenix Kennels, LLC will take the puppy for return only at the buyer’s expense and no paid monies to Phoenix Kennels, LLC will be refunded.
  7. ALL shipping costs related to the chosen puppy are the buyer’s responsibliity. The buyer acknowledges that weather and holidays may make it difficult to ship in a timely manner. The buyer also acknowledges that shipping of bull-breed dogs is heavily regulated by airlines.
  8. Upon request by the buyer, Phoenix Kennels, LLC will provide a vet certification of health for the puppy upon leaving Phoenix Kennels, LLC. The buyer must have the puppy inspected by a certified veterinarian within 48 hours of receiving the puppy. Phoenix Kennels, LLC must receive a written notice of health inspection by the buyer’s veterinarian within 10 days of the inspection. If the buyer chooses not to have the puppy inspected or if Phoenix Kennels, LLC does not receive the written notice in said time, the buyer agrees that Phoenix Kennels, LLC will not be held responsible for any health related liabilities. The buyer agrees that Phoenix Kennels, LLC has the right to discretion of monteary liability related to health complications at the time of the buyer’s veterinarian health inspection for chosen puppy.
  9. Phoenix Kennels, LLC does not guarantee the ability for breeding or the show quality of the buyer’s chosen puppy.
  10. The buyer must register the puppy with the Victorian Bulldogge Association (VBA) within 6 months of receipt of the puppy.
  11. If the puppy is recognized by the VBA as an Olde Victorian Bulldogge, the puppy MUST NOT be registered with ANY OTHER ORGANIZATION OR REGISTRY. Doing so is in breach of this contract and the buyer acknowledges that Phoenix Kennels, LLC will have all ownership rights to the dog and it must be returned to Phoenix Kennels, LLC at the buyer’s expense with no monies refunded to the buyer.
  12. The buyer agrees to be responsible for any legal, travel, shipping, or other fees and expenses that are incurred by Phoenix Kennels, LLC if the buyer is in breach of this contract.
  13. The buyer agrees that the kennel prefix “PHOENIX” will be in front of the puppy’s registered name and that no other kennel prefix can be in the puppy’s registered name. The buyer agrees that puppies taken back from any litters they produce and those of which that carry the Phoenix line gives Phoenix Kennels, LLC the right to place such kennel prefix in front of said dogge/puppy’s name.
  14. Phoenix Kennels, LLC will not allow the selection, shipping, or pick up of any dogge/puppy without the buyer’s signature on each page of this contract. If a buyer chooses not to sign this contract, all deposits paid remain NON REFUNDABLE.
  15. Phoenix Kennels, LLC is not responsible for lack of communication if buyer provides incorrect contact information or if contact information is not current. It is the responsibility of the buyer to ensure communication methods as discussed in this contract are available to them. If Phoenix Kennels, LLC cannot reach the buyer by the below provided contact information and no new information has been provided by the buyer, then the buyer will be removed from the selection list.
  16. Payments: Payment will be accepted by personal check, paypal, or hand delivered cash only. Please Do Not Send Cash In The Mail. All deposits / payments made by personal check are subject to approval. If a deposit or payment check does not clear the issuer’s bank, then the puppy selection will be forfeited until balance owed is fulfilled. Paypal payments must be made by an account holder with instant transfer only – no credit or debit card payments through paypal will be accepted.
